Organizer Event Agreement
Agreement accepted when an Organizer enables ticket sales for an Event
This Agreement supplements the OnlyDance Terms of Use and Privacy Policy. It applies when an Organizer enables ticket sales for an Event in the app.
1. Organizer’s role
The Organizer is responsible for organizing and delivering the Event and, unless the Event page clearly states otherwise, is the seller of admission to the Event. The Organizer controls Event details, Ticket Price, capacity, venue, schedule, admission rules and Event-specific refund conditions, subject to applicable law.
The Organizer must comply with laws that apply to the Event, including consumer, safety, tax, accounting and data-protection rules in Poland, the country where the Event takes place and any mandatory rules protecting foreign Buyers.
2. Organizer responsibilities
The Organizer must provide complete and accurate Event information and is responsible for:
- having the authority, permissions and rights needed to run and promote the Event;
- the venue, staffing, safety, accessibility and lawful operation of the Event;
- honouring valid Tickets and communicating important Event changes promptly;
- complying with applicable consumer, tax, accounting and invoicing duties;
- using Buyer and Attendee information only for legitimate Event-related purposes and required legal duties.
3. OnlyDance’s role, Firebase and Stripe
The Organizer authorizes OnlyDance to provide the ticketing platform for the Event, including displaying the listing, facilitating orders and payments, issuing electronic Tickets, sending transaction or Event-related messages, processing permitted refunds and preparing settlement.
OnlyDance may use Firebase/Google for platform infrastructure and Stripe or another payment provider for payments, fraud checks, refunds, chargebacks and payouts. The Organizer authorizes OnlyDance and those providers to process the information reasonably needed for these purposes. OnlyDance does not become the Event organizer merely because it provides these services.
4. Prices, payments and payout
The Buyer will see the Ticket Price, any OnlyDance Platform Service Fee and the total price before confirming payment. Payments may be processed through Stripe or another provider shown in checkout.
The Organizer authorizes OnlyDance to receive the Ticket Price for settlement to the Organizer and to deduct or reserve amounts connected with refunds, chargebacks, duplicate payments, payment-provider costs, legal holds or other adjustments disclosed or agreed for the Event.
The final payout will be sent to the Organizer’s verified payout account after the Event, within the payout period shown in the app or Organizer dashboard. A payout may be delayed while verification, refunds, disputes, suspected fraud, legal requirements or payment-provider restrictions are unresolved.
5. Event changes, cancellations and refunds
The Organizer must notify OnlyDance promptly about cancellation, postponement, a material date or venue change, reduced capacity, safety concerns or inability to deliver the Event.
OnlyDance may pause ticket sales, inform Buyers and process refunds where required by law, the Event terms, payment-provider rules or the Organizer’s instructions. The Organizer remains responsible for Ticket Price refunds, chargebacks and direct payment costs caused by the Organizer’s cancellation, inaccurate information, breach or failure to deliver the Event, except to the extent caused by OnlyDance.
If a refund or chargeback occurs after payout, OnlyDance may recover the relevant amount from the Organizer or deduct it from a future payout.
6. Organizer information and verification
The Organizer must keep identity, contact, tax and payout information accurate and current. OnlyDance may request reasonable verification information and may pause publication, ticket sales or payout until required checks are completed.
7. Taxes, sales documents and records
As the seller of admission, the Organizer is responsible for determining and fulfilling any tax, invoicing, fiscal-recording and accounting obligations applicable to Ticket sales. OnlyDance is responsible for taxes and records relating to its own Platform Service Fee.
OnlyDance may provide Buyers with electronic Tickets, order confirmations and payment confirmations. Unless expressly identified and lawfully issued as such, these documents are not an invoice or fiscal receipt.
8. Attendee data, GDPR/RODO and Article 14 notices
For platform accounts, checkout, ticketing, payment records, service messages and platform security, OnlyDance acts as controller unless stated otherwise. For Event operation, admission, Event-specific customer service and Event legal duties, the Organizer may act as an independent controller of Buyer/Attendee data it receives.
The Organizer must protect Buyer/Attendee data, use it only for the Event and required legal duties, and not use it for unrelated marketing or disclose it to others without a valid legal basis and required consent. If the Organizer provides attendee emails or other personal data to OnlyDance that were not collected directly by OnlyDance, the Organizer confirms that it has a lawful source and will provide any information needed for GDPR/RODO Article 14 notices.
Any suspected loss, misuse or unauthorized disclosure of OnlyDance platform data must be reported to OnlyDance promptly at support@onlydanceapp.com with enough information to assess notification duties.
9. Marketing restrictions
The Organizer must not use Buyer/Attendee emails, phone numbers, push tokens or similar contact details for direct marketing unless it has the separate consent or other legal basis required by GDPR/RODO and Article 398 of the Polish Electronic Communications Law (PKE). Acceptance of this Agreement, Terms or Privacy Policy is not marketing consent.
10. Event content
The Organizer confirms that it has the right to use all descriptions, photographs, logos, music, trademarks and other material submitted for the Event. The Organizer gives OnlyDance permission to host, format, display and promote that material for the purpose of operating and marketing the Event and the Platform.
The Organizer must not publish an Event or content that is unlawful, fraudulent, misleading, unsafe, discriminatory or infringes another person’s rights.
11. Suspension, liability and law
OnlyDance may remove or restrict an Event, pause sales, block access or hold a payout where reasonably necessary for safety, verification, legal compliance, payment-provider requirements, fraud prevention, unresolved refunds or a material breach of this Agreement.
Each party is responsible for its own actions, breaches and legal obligations. OnlyDance is not responsible for incidents caused solely by Firebase/Google, Stripe or another provider where OnlyDance has acted with reasonable care and the law allows this limitation. Nothing in this Agreement excludes liability or data-protection duties that cannot lawfully be excluded.
Polish law applies, subject to mandatory rights that cannot be excluded. If a provision is invalid, the remaining provisions continue to apply. OnlyDance may update this Agreement for future Events; the version accepted when ticketing is enabled remains applicable to that Event unless a change is required by law or accepted by the Organizer.
12. Electronic acceptance
By selecting the required toggle or checkbox and enabling ticket sales, the Organizer confirms that it has read and accepts this Agreement, the Terms of Use and the Privacy Policy; the person accepting has authority to act for the Organizer; the Event information is accurate; and OnlyDance is authorized to provide the ticketing, payment, refund and settlement services described above.
